The High Court today fixed Aug 28 for case management of a defamation suit filed by Tan Sri Eric Chia against DAP secretary-general Lim Guan Eng.
The former Perwaja director’s suit is over a police report lodged by Lim regarding Perwaja Terengganu Sdn Bhd.
Chia filed the suit on Jan 2, 2002.
In his statement of claim, Chia stated that Lim, in a police report made at the Sentul police station on April 11, 1996, entitled ‘First Report on Financial Malpractices, Abuse Of Power, Corruption And Fraud In Perwaja Terengganu Sdn Bhd (Perwaja)’, had portrayed him as dishonest and had acted in a manner detrimental to the company.
The report also claimed that Chia was corrupt and unfit to serve the company and had acted in conflict of his duties.
Chia sought general damages, aggravated and/or exemplary damages and other relief deemed fit by court, claiming that the report had caused serious damage to his reputation.
Lim, in his statement of defence, stated that he relied on the defence of qualified privilege and had acted in public interest.
On June 26, the Kuala Lumpur Sessions Court judge Akhtar Tahir acquitted Chia of criminal breach of trust involving RM76.4 million without calling for his defence.
The judge described the charges against Chia as "weak". The decision came after a hearing that stretched over three years.
The prosecution filed for a notice of appeal against the acquittal two days later. The case is set to be heard at the High Court on July 22.
